Client was charged with DWI following a blood draw showing a BAC of .14. During a two-day jury trial, we were able to successfully keep out the blood analysis and the client was found not guilty.
Client was a juvenile charged with sexual assault against another student that occurred during the school day, but off-campus. The allegations involved that the other student was forced by the client to perform oral sex. At a trial, we were able to show that the complaining witness had credibility issues, may have fabricated the allegations in order to avoid being slut-shamed and that the entire matter was consensual. Following a bench trial, our client was found not guilty.
Client was a juvenile charged with a high-profile murder. Charges were dismissed after the preliminary hearing when we were able to successfully challenge the admissibility of a substantial amount of the prosecution’s evidence.
Client was a youth football coach who was alleged to have used corporal punishment against one of the players while at a hotel during a weekend tournament. At trial, we were able to raise the issue of whether the complaining witness was biased by a pending civil suit and whether the prosecution had even made out the elements of their case. The charges were dismissed mid-trial by the judge on our motion.
Client was charged with a DWI after falling asleep at a red light and being awoken by the police. We successfully argued to the prosecution that there were legal issues that may result in the results of the client’s breath test being excluded and our client was offered a reduced charge of Improper Driving, a traffic infraction, rather than a DWI.
Client was charged with Murder for his alleged participation in a drug deal gone wrong. The victim was found about a week after his disappearance wrapped in garbage bags and disposed of over a bridge in a park. The victim’s DNA was found in the client’s bedroom and his vehicle. At a seven-day jury trial, we successfully argued that there was no premeditation and ultimately the jury found the client guilty only of second-degree murder after three days of deliberation. After a sentencing hearing at which the jury learned that the client was a three-time prior violent felon, we were still able to successfully argue for a sentence of just 23 years.
Client was charged with Possession With Intent to Distribute Cocaine after being involved in three hand-to-hand sales with an undercover detective captured on audio recordings. After a plea, we were successfully able to argue for a sentence of no active incarceration despite sentencing guidelines calling for at least a year.
Client was charged following an argument at a convenience store with a known acquaintance that resulted in a shooting. After a three-day jury trial, client was convicted of a lesser-included offense which resulted in a dismissal of an additional charge carrying a mandatory three-year sentence.
Client was charged with DWI after a 911 caller reported a car swerving on the road and hitting the guardrail. Client was located by police with a blown out tire on the side of I-95 and subsequently a blood draw indicated a BAC of .12. We were able to have the case dismissed by the prosecution due to witness issues and discrepancies in the field sobriety tests.
Client was charged with malicious wounding for an allegation regarding her live-in boyfriend’s daughter who claimed that client broke her nose in an argument turned physical. At preliminary hearing, we were able to show significant discrepancies between the daughter’s testimony and prior statements such that the judge dismissed the charges.
Client was charged with Possession With Intent to Distribute LSD after a series of hand-to-hand sales with an undercover detective who had contacted him on social media. We were able to provide mitigation to the prosecution to convince them to allow our client to plead to a misdemeanor offense that will be dismissed upon the successful completion of community service.
A law-enforcement officer was charged with reckless driving following an on-duty traffic accident that resulted in the death of the other driver. After a one-day jury trial where we showed that the other driver was at fault for the accident and that the accident reconstruction was speculative, the jury returned a verdict of not guilty against our client.
